This policy explains how Transcend Center ("we", "us") collects, uses, discloses, stores, and protects personal information when you visit this website or submit an application through it. We operate from Kelowna, British Columbia, and handle personal information in accordance with the Personal Information Protection Act (British Columbia) and the Personal Information Protection and Electronic Documents Act (Canada).

By using this website or submitting an application, you agree to the practices described in this policy. You do not have to provide personal information, but some parts of the website, including the application, cannot work without it.

1. Who we are

Transcend Center is operated by Nylund Holdings Ltd., located at 101-1865 Dilworth Drive, Kelowna, BC V1Y 9T1, Canada. We are responsible for the personal information we collect through this website.

2. What personal information we collect

Personal information is information that identifies you, or could reasonably be linked to you, alone or combined with other information. Information that has been anonymised so it can no longer identify anyone is not personal information.

When you visit this website, we and our service providers may collect your IP address, browser and device type, operating system, pages viewed, time spent on pages, the page that referred you, session length, approximate location based on IP address, and how you interacted with the video. This is collected through cookies and similar technologies described in section 5.

3. Sensitive information and consent

Some information, such as health or mental health history, is sensitive. The application asks whether there is anything about your physical or mental health we should be aware of. We only ask for what we need to review your application and to make sure a ceremony is safe and appropriate for you. Please do not include information you are not comfortable sharing.

Before we collect sensitive information, we ask for your explicit consent. By submitting an application, you consent to us collecting, using, disclosing, and storing that information for the purposes in section 4 and as described in section 8. Consent is always optional, but if you do not give it we may not be able to consider your application.

You can withdraw your consent at any time by emailing jake.nylund@gmail.com. Withdrawing consent does not affect anything we did with your information before you withdrew it. It may also mean we can no longer process your application or provide a ceremony.

We use personal information to:

The legal basis for most of this is your consent. Some uses are needed to fulfil a booking or to meet legal obligations. Our website security and fraud prevention rely on our legitimate interest in protecting the site and our clients. We do not use personal information for purposes beyond these without your consent.

Cookies are small files that a website places on your device. Some are removed when you close your browser, and others remain for a set time. We use both types.

You can also block or delete cookies through your browser settings. If you do, some parts of the website may not work as intended.

6. Advertising

We advertise our services on Meta (Facebook and Instagram). Meta may place its own cookies or tracking tags on this website so it can measure ad performance and show ads to people who have visited it. We do not control how Meta uses data it collects directly. You can manage advertising preferences through your browser and through your Meta account settings.

We use service providers to run this website and process applications and payments. They process personal information only on our behalf and only as needed to provide their service, under contracts that require them to protect it:

9. Where your information is stored

Our head office is in Canada. Some of our service providers store or process information outside Canada, including in the United States. These include Vercel, Resend, Stripe, PayPal, Google, Meta, Wistia, and Calendly. When they do, we rely on their contractual protections, and the information may be subject to the laws of the country where it is processed, including lawful access by its authorities.

10. How long we keep information

We keep personal information only as long as needed for the purpose it was collected for, or as required by law. Different kinds of information are kept for different periods:

No method of transmission or storage is completely secure, so we cannot guarantee the security of information you send us over the internet. If we believe there has been a breach that creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as the law requires.

We make reasonable efforts to keep the personal information we hold accurate and complete. If you tell us something is wrong, we will correct it without delay and let you know.

We will respond within 30 days of receiving a complete request. If we need more time because the request is complex, we will tell you the reason and the new timeline within the first 30 days. We do not charge a fee for most requests. If we do, we will tell you in advance.

We encourage you to contact our Privacy Officer first, so we can address your concern directly. If you are still not satisfied, you can contact the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada.

14. Children and minors

Our services are for adults only. You must be 18 or older to submit an application. Do not send us personal information if you are under 18. If we learn that we have collected information from someone under 18, we will delete it.

This website does not link to other websites. Our video and application form are provided by the service providers listed in section 7, and their own policies apply to the information they process.

16. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or in the law. The date at the top shows when it was last changed. If we make a material change, we will tell you before it takes effect, by posting a prominent notice on this website and, where we have your email address, by email. Where the law requires it, we will get your consent before we use your information in a new way.
